For both permanent and temporary in-ground pools, spas, or water gardens, a freestanding fence must surround the area. This fence should have a height between 48 inches and 72 inches above ground level. Additionally, the fence must be located at least three feet away from the nearest point of the pool, pond, or spa.
All above-ground permanent or temporary pools, ponds, or spas must be surrounded by a fence that meets one or more of the following criteria:
- A fence installed within three feet of a pool, pond, or spa must be between 48 inches and 72 inches in height from ground level.
- If the fence is attached to a deck or walkway, it must be at least 36 inches above the surface of that deck or walkway and comply with all relevant regulations.
- A pool wall that is 48 inches or higher from ground level must have steps, ladders, or other means of pool access removed when the pool is not in use.
- For both permanent and temporary in-ground pools, spas, or water gardens, a freestanding fence must surround the area. This fence should have a height between 48 inches and 72 inches above ground level. Additionally, the fence must be located at least three feet away from the nearest point of the pool, pond, or spa
Fencing will not be required if the following conditions are met:
- Pools, spas, or water gardens that have a secure, solid cover that can be locked. These covers must be in place whenever the pool, pond, or spa is not in use or is unsupervised by an adult. Additionally, the pool must be equipped with a power safety cover that complies with ASTM F 1346 standards.
- Pools, spas, or water gardens that are entirely enclosed within a building do not require external fencing.
- For temporary pools, they may be drained and kept completely empty of water between uses instead of being fenced.
The structural requirements for fencing are as follows:
- The fence must be designed to withstand a force of 200 pounds from any direction.
- It should be constructed in such a way as to prevent the penetration of any object larger than six inches in diameter.
- Additionally, all fences must include a locking door or gate that meets the height and structural requirements outlined in this section.
